License of the the original HTML is CC-Attribution. This means that you’ll have to post a link to http://www.nodethirtythree.com/ on your site.
Can you point me to where the CC license is noted? I’d be happy to update this with the correct license type, but I don’t see anything on nodethirtythree.com with a reference to this theme. Also, the way I read the CC attribution license, the author would need to link back since they are modifying it and distributing it.
